Terms of Service

1. One-Time Implementation Fee

Every new website includes a one-time implementation fee. The fee scales with the scope and complexity of the site, including the configuration, content migration, customization, and launch preparation required. Before work begins, Kaddie will provide a written quote describing the agreed scope and fee.

Implementation may include configuring the site, migrating content, customizing the look and feel, and preparing the site for launch. Work outside the agreed scope requires written approval and may result in an updated quote.

Implementation fees are billed as stated in the quote and are non-refundable once work or content migration has commenced.

2. Subscription Tiers and Monthly Support Requests

All subscription tiers provide full access to core platform features, with service levels and support allocations varying by plan:

• •Par ($99 / month): Pay-per-update request model billed at $99/hour. Request submissions carry the lowest priority and are scheduled behind Birdie and Eagle requests.
• •Birdie ($179 / month): Includes 1 standard support request per month with a 3-business-day turnaround time.
• •Eagle ($279 / month): Includes 4 standard support requests per month with a 24–48-hour turnaround time (weekends included), plus early adoption/input access around new features and reduced rates on future feature rollouts.

3. Support Request Rules & Standard vs. Premium Definitions

• •Expiration: Monthly support requests do not roll over from month to month. Allocations reset based on the client's monthly subscription renewal date, and unused requests expire at the end of each billing cycle.
• •Standard Support (eligible for monthly support allocations across qualifying tiers): restricted to maintenance, typo fixes, CMS guidance, bug fixes, and basic redirects.
• •Premium Support & Custom Work (billed separately or at hourly rates): building a new page, layout restructuring of a page, component additions or swaps, complex asset integration, creating an event details page, creating a new lead form, or building custom components (billed at $99/hour).

4. Billing, Payments, and Cancellations

• •Automatic Renewal: Subscription fees are billed on a recurring monthly basis via Stripe. You authorize us to automatically charge your payment method on a recurring basis until you cancel.
• •Cancellation Terms: Subscriptions may be canceled at any time. To avoid billing for the subsequent cycle, notice must be provided prior to your next renewal date. No refunds are provided for partial months or unused monthly support request allocations.

5. Client Responsibilities & Content

• •Ownership: You retain full ownership of all logos, text, imagery, trademarks, and content you provide ("Client Content"). You grant us a worldwide, non-exclusive license to host, display, and process your content to operate the platform.
• •Accuracy and Compliance: You are solely responsible for the accuracy of your course information, rates, tee-sheet links, and compliance with applicable laws, regulations, and ADA guidelines.
• •Third-Party Services: Our platform integrates with third-party tee-sheet software and payment gateways. We are not liable for outages, API limitations, or errors originating from third-party services.

6. Intellectual Property & Limitation of Liability

• •Platform Ownership: All platform infrastructure, underlying software, architecture, component libraries, and UI templates remain the exclusive intellectual property of JDApplications.
• •Limitation of Liability: JDApplications shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits arising from your use of the Service or tee-sheet downtime. Total aggregate liability is limited to the total subscription and setup fees paid by you in the preceding twelve (12) months.
